SYMAR Terms & Conditions

These Terms and Conditions (the “Terms”) govern access to and use of the SYMAR website, application, platform, research tools, subscriptions, credits, and related services (collectively, the “Services”). The Services are operated by OpinioAI International s.r.o., a company registered in Brno, Czech Republic with identification number IČO 19983328, doing business as SYMAR (“SYMAR,” “we,” “us,” or “our”).

By creating an account, accessing the Services, or using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you must not access or use the Services.

Additional terms, order forms, product terms, data processing terms, or policies may apply to specific features or subscriptions. If there is a conflict between these Terms and a signed agreement between you and SYMAR, the signed agreement will control for the subject matter it covers.

1. About SYMAR and the Services

SYMAR is an AI research platform designed to help market, academic, business, and product researchers explore synthetic opinions, simulated target-market responses, ideal customer profiles, buyer personas, and related research outputs.

The Services use third-party large language models and related AI technologies to generate responses based on prompts, persona settings, research queries, and other materials provided through the platform. AI-generated outputs are probabilistic and synthetic. They should not be treated as deterministic facts, professional advice, legal advice, investment advice, medical advice, or a substitute for independent validation.

SYMAR is built in Europe and intended primarily for business and professional use globally. The United States is one of SYMAR’s market focuses, and users remain responsible for complying with all laws and regulations that apply to their use of the Services in their jurisdiction.

2. Eligibility and Account Registration

You must be at least 18 years old and have legal capacity to use the Services. If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to that entity.

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may remove, reclaim, or change usernames or account identifiers that we determine are inappropriate, misleading, infringing, or otherwise objectionable.

3. Credits, Subscriptions, and Fees

Certain features require credits. Credits are consumed when you use platform features, and different features or models may consume different numbers of credits. Credit consumption visible in the product before or during use.

You may obtain credits through monthly or yearly subscriptions, credit purchases, or other plans made available by SYMAR. Credits are associated with the relevant account or organization and are not transferable outside that account or organization unless we agree otherwise in writing.

We use Stripe and may use other payment processors to manage payments and subscriptions. You agree to provide complete and accurate billing information and to keep your payment details current. You authorize us or our payment processor to charge applicable fees, taxes, and recurring subscription amounts to your selected payment method until cancellation.

Unless otherwise stated in an order form or written agreement, prices may change from time to time, and payments are due in the currency shown at checkout or on the invoice. We may also issue invoices payable by bank transfer, including IBAN/SWIFT, where agreed.

4. Refunds and Cancellation

Because SYMAR is consumption-based, refunds are limited. You may qualify for a refund if both of the following are true:

  • you purchased credits within the last 14 days; and
  • you have not spent more than 20 allocated credits from that purchase or subscription period.

To request a refund, contact us at support@symar.ai or through in-app chat. We may refuse refund requests that do not meet the above conditions, that appear abusive, or that relate to credits already consumed.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current paid term unless otherwise stated in your plan or agreement. You remain responsible for fees incurred before cancellation.

5. Your Inputs and Outputs

To use the Services, you may provide prompts, research queries, persona definitions, uploaded data, segments, business profiles, images, presentations, transcripts, fine-tuning data, or other materials (“Input”). The Services may generate responses, reports, chats, text, data points, personas, or other materials based on your Input (“Output”).

You are responsible for your Input, including ensuring that you have all rights, licenses, permissions, and lawful bases needed to provide it to SYMAR and process it through the Services. You must not submit Input that violates these Terms, applicable law, third-party rights, confidentiality obligations, or data protection requirements.

As between you and SYMAR, you retain ownership of your Input. Subject to your compliance with these Terms, you own the Output generated for you through the Services to the extent permitted by applicable law.

You grant SYMAR the limited rights necessary to host, process, transmit, display, and otherwise use your Input and Output only as needed to provide, maintain, secure, support, and operate the Services, comply with law, enforce these Terms, and prevent misuse. SYMAR will not use your Input or Output to train third-party large language models, and SYMAR will not use your Input or Output to improve the Services. SYMAR improves the Services through direct client feedback, support interactions, product interviews, and operational learnings that do not require using customer Input or Output as improvement data.

6. AI Outputs and Research Limitations

The Services are designed to support research and insight generation, not to produce guaranteed facts. AI-generated Output may be inaccurate, incomplete, biased, outdated, or unsuitable for a specific purpose.

You are responsible for reviewing, testing, validating, and deciding how to use any Output. You should not rely on Output as the sole basis for decisions that could materially affect legal rights, financial outcomes, employment, health, safety, eligibility, or other high-impact matters.

The Services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, GLBA, or similar laws unless SYMAR expressly agrees in writing. If your use case is subject to such laws or involves regulated data, sensitive personal data, protected health information, financial data, children’s data, or other high-risk data, you must not use the Services for that use case without a separate written agreement with SYMAR.

7. Fine-Tuning and Customer Data

Some features may allow customers to provide data for analysis, modeling, or fine-tuning. You own the data you upload for those purposes, and you must ensure that you have the right to provide it.

Fine-tuning or modeling data is processed to provide the requested feature. It is treated as confidential and is used to tweak third-party large language models. Unless otherwise agreed in writing, any fine-tuned model or hosted model configuration remains hosted and administered through the SYMAR account for which it was created. SYMAR may delete hosted fine-tuned models or related data upon your request, subject to technical, legal, security, and backup limitations.

8. Intellectual Property Rights

The Services, website, application, software, databases, functionality, designs, text, graphics, content, trademarks, service marks, logos, and other SYMAR materials are owned by SYMAR or licensed to SYMAR and are protected by intellectual property and other laws.

Except as expressly permitted by these Terms or a written agreement, you may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, reverse engineer, or otherwise exploit any part of the Services or SYMAR materials for a commercial purpose without our prior written permission.

Subject to these Terms, SYMAR grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your internal business or professional purposes.

9. Feedback

We welcome client feedback, product suggestions, support comments, and other ideas about the Services (“Feedback”). You may provide Feedback voluntarily. We may use Feedback to maintain, develop, and improve the Services without restriction or obligation to you, provided that we do not use your Input or Output as improvement data.

If Feedback includes confidential information, we will treat it consistently with any confidentiality obligations that apply between you and SYMAR.

10. Confidentiality

If you and SYMAR exchange confidential business, technical, product, customer, roadmap, pricing, security, or other non-public information, each party must use reasonable care to protect the other party’s confidential information and may use it only for the purpose for which it was disclosed.

Confidential information does not include information that is publicly available without breach, already known without restriction, independently developed without use of the confidential information, or lawfully received from a third party without confidentiality obligations.

If a party is legally required to disclose confidential information, it should provide prompt notice where legally permitted and cooperate in seeking confidential treatment.

11. Prohibited Activities

You may use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • use the Services for an illegal, harmful, fraudulent, abusive, or unauthorized purpose;
  • submit Input that infringes, violates, or misappropriates third-party rights;
  • upload malicious code, malware, spyware, or similar harmful material;
  • interfere with, disrupt, overload, or impair the Services or related systems;
  • bypass, disable, or interfere with security, access, rate-limit, credit, or usage controls;
  • scrape, harvest, or systematically extract data from the Services without written permission;
  • use bots, scripts, or automated systems except where expressly permitted by SYMAR;
  • attempt to reverse engineer, decompile, disassemble, or copy the Services or underlying software except where applicable law prohibits this restriction;
  • impersonate another person or entity or misrepresent your affiliation;
  • use the Services to harass, abuse, defame, threaten, or harm another person;
  • use the Services to develop a competing product or service except as permitted by law;
  • submit sensitive personal data or regulated data unless you have a written agreement with SYMAR authorizing that use; or
  • use the Services in a way that would require SYMAR to comply with laws or obligations not contemplated by these Terms or a written agreement.

12. User-Generated Content and Public Contributions

SYMAR may invite users to contribute comments, case studies, testimonials, blog materials, forum posts, or similar content. You may decline any such request.

We will not publish your customer content, case study, testimonial, or similar public-facing material without your approval. If you choose to submit content for publication, you grant SYMAR the rights necessary to review, edit, publish, display, and distribute that content in the approved form. You retain ownership of content you provide unless otherwise agreed.

13. Third-Party Services and Content

The Services may use or link to third-party services, websites, model providers, payment processors, analytics tools, communication tools, hosting providers, and other subprocessors or vendors. Third-party services are subject to their own terms and policies.

SYMAR is not responsible for third-party websites, third-party content, or purchases you make through third parties. Links or integrations do not imply endorsement unless expressly stated.

14. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, available at www.symar.ai/privacy-policy. The Privacy Policy explains how we collect, use, share, and protect personal data.

If you access or use the Services from outside the European Union, you understand that your personal data may be transferred to and processed in the EU and other locations as described in the Privacy Policy and applicable data processing terms.

15. Service Management, Suspension, and Enforcement

We may monitor use of the Services for security, operational integrity, compliance, and enforcement. We may refuse, restrict, suspend, or terminate access to the Services, remove or disable content, block certain activity, or take other appropriate action if we believe that you have violated these Terms, applicable law, third-party rights, or the security or integrity of the Services.

We may also suspend or limit access where required to prevent harm, address security concerns, comply with law, protect other users, or manage service operations.

16. Term and Termination

These Terms remain in effect while you access or use the Services. You may stop using the Services at any time, subject to any payment obligations, subscription terms, or written agreements that continue to apply.

We may terminate or suspend your account or access to the Services if you breach these Terms, fail to pay amounts due, create risk for SYMAR or others, or use the Services unlawfully or abusively. After termination, you must stop using the Services, and provisions that by their nature should survive will continue to apply.

17. Modifications and Service Availability

We may update, modify, suspend, discontinue, or remove parts of the Services from time to time. We may also change pricing, features, credits, or plans prospectively.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times, 100% of the time. The Services may be affected by maintenance, updates, third-party providers, network issues, security events, or other factors outside our control.

18. Corrections

The Services and website may contain typographical errors, inaccuracies, omissions, pricing errors, availability errors, or other mistakes. We may correct, update, or change information at any time without prior notice.

19. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, SYMAR disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

SYMAR does not warrant that Output will be accurate, factual, complete, reliable, lawful for your intended use, or suitable for any particular purpose. You use the Services and Output at your own risk and are responsible for validating Output before relying on it.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

20. Limitation of Liability

To the fullest extent permitted by applicable law, SYMAR and its directors, employees, contractors, affiliates, partners, and agents will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including lost profits, lost revenue, loss of data, business interruption, or loss of goodwill, arising from or related to the Services or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, SYMAR’s total liability for any claim arising from or related to the Services or these Terms will be limited to the amount you paid to SYMAR for the Services during the six months before the event giving rise to the claim.

Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless SYMAR and its directors, employees, contractors, affiliates, partners, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

  • your Input, Output, or use of the Services;
  • your breach of these Terms;
  • your violation of applicable law;
  • your violation of third-party rights; or
  • harmful, unauthorized, or abusive activity conducted through your account.

We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.

22. Electronic Communications and Signatures

By using the Services, emailing us, or completing online forms, you consent to receive electronic communications from SYMAR. You agree that electronic notices, agreements, disclosures, and other communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

You also agree to the use of electronic signatures, contracts, orders, and records where permitted by law.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of Czech Republic, excluding conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

If a dispute arises, the parties will first try to resolve it through good-faith informal negotiations for at least 30 days after written notice of the dispute. If the dispute is not resolved informally, it will be resolved in accordance with the dispute-resolution forum and process required by applicable law or any written agreement between the parties.

The current Terms are intended primarily for business use. If mandatory consumer protection laws apply to you, nothing in these Terms limits rights that cannot be waived under those laws.

24. United States Users

The United States is one of SYMAR’s market focuses. If you access or use the Services from the United States, you are responsible for ensuring that your use complies with applicable federal, state, and local laws.

The Services are not intended for regulated use cases that require SYMAR to comply with sector-specific U.S. laws unless SYMAR has agreed to those requirements in writing.

25. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on the website and update the “Last updated” date. For material changes, we may provide additional notice, such as email or in-app notice.

Your continued use of the Services after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
